What is the Employment Equity Act?
The Employment Equity Act 55 of 1998 promotes equality in the workplace by eliminating unfair discrimination and implementing affirmative action measures.
What is the difference between Employment Equity (EE) and Affirmative Action (AA)?
- Employment Equity (EE) is a broader strategy that promotes fairness, equality, and representation in the workplace. It ensures that historically disadvantaged groups have equitable access to employment, training, and career growth.
- Affirmative Action (AA) is a specific set of measures within Employment Equity aimed at addressing past discrimination by actively promoting and advancing designated groups (Black people, women, and persons with disabilities) in recruitment, training, and promotions.
Who are considered designated groups?
Designated groups refer to South African citizens who were historically disadvantaged due to apartheid-era discrimination. These groups include:
- Black people (African, Coloured, and Indian South Africans)
- Women
- Persons with disabilities
Employers must prioritize fair representation of these groups across all occupational levels in line with the Employment Equity Act.
Who qualifies as a designated employer?
A designated employer is a company that:
- Employs 50 or more people, or
- Has an annual turnover exceeding industry-specific thresholds (e.g., R15 million for wholesale trade, R30 million for manufacturing).
Designated employers are legally required to submit Employment Equity reports and implement EE plans to ensure workplace diversity and inclusivity.
What is unfair discrimination?
Unfair discrimination refers to any workplace practice or policy that excludes, limits, or disadvantages individuals based on factors unrelated to job performance. The Employment Equity Act prohibits discrimination based on:
- Race, gender, age, disability, sexual orientation, marital status, religion, or political beliefs.
- Pregnancy, HIV status, or language.
However, fair discrimination is allowed when required for affirmative action measures or job-specific requirements (e.g., physical ability for a firefighter position).
What is the difference between the EEA2 and EEA4 forms?
- EEA2 Form – This is the Employment Equity Report, which provides a breakdown of workforce demographics, detailing the number of employees from designated groups at different occupational levels. Employers must submit this annually to track progress on EE goals.
- EEA4 Form – This is the Income Differentials Report, which analyzes pay gaps between different race and gender groups to identify unfair wage disparities.
Both forms are mandatory for designated employers and must be submitted to the Department of Labour.
